Terms and Conditions

1. Definitions

For purposes of this Agreement, the following terms shall have the meanings set forth below:

"Bot" or "Trading Bot"

The automated trading software provided by PumpFun Sniper Bot, including all algorithms, code, and associated functionality.

"Platform"

The web-based interface, dashboard, and associated tools through which Clients access and manage the Bot.

"Subscription"

The paid or free access tier selected by the Client, determining available features and usage limits.

"API"

Application Programming Interface connections to external services including but not limited to pump.fun, Solana blockchain, and wallet providers.

"Trade" or "Transaction"

Any buy, sell, or swap operation executed through the Bot on the Solana blockchain.

"Wallet"

The cryptocurrency wallet connected to the Platform for executing trades.

2. License Grant

2.1 Grant of License

Subject to your compliance with this Agreement and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Platform through our web interface
• Configure and operate the Bot within your subscription tier limits
• View and download your trading history and analytics
• Use our documentation and educational materials

2.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the Bot or Platform
• Reverse engineer, decompile, or disassemble any part of our software
• Rent, lease, loan, sell, or sublicense the Bot to third parties
• Use the Bot to develop competing products or services
• Remove or alter any proprietary notices or labels
• Access the Bot's source code or underlying algorithms

3. Subscription Plans

3.1 Plan Tiers

We offer the following subscription tiers:

You may upgrade or downgrade your subscription at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the start of the next billing cycle.

4. Payment Terms

4.1 Billing

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected billing cycle. We accept payment via:

• Credit/Debit Cards (Visa, Mastercard, American Express)
• Cryptocurrency (SOL, USDC, USDT)
• Bank Transfer (Enterprise plans only)

4.2 Auto-Renewal

Unless you cancel before the end of your current billing period, your subscription will automatically renew at the then-current rate.

4.3 Late Payments

Failure to pay may result in:

• Suspension of services after 3 days
• Termination of account after 14 days
• Late fees of 1.5% per month on outstanding balances

5. Refund Policy

5.1 Cooling-Off Period

New subscribers may request a full refund within 7 days of their initial purchase, provided:

• You have executed fewer than 5 trades using the Bot
• You have not violated any terms of this Agreement
• You submit your request through our official support channels

5.2 No Refund Situations

Refunds will NOT be provided for:

• Trading losses incurred while using the Bot
• Partial months of service after cancellation
• Accounts terminated for policy violations
• Services rendered during the subscription period
• Cryptocurrency payment processing fees

5.3 Processing Time

Approved refunds will be processed within 5-10 business days and returned to the original payment method.

6. User Obligations

6.1 Compliance

You agree to:

• Comply with all applicable laws and regulations in your jurisdiction
• Ensure you are legally permitted to trade cryptocurrencies
• Report and pay any applicable taxes on your trading profits
• Maintain adequate funds in your wallet for trading and gas fees

6.2 Responsible Use

You acknowledge and agree that:

• You are solely responsible for your trading decisions
• You will configure the Bot according to your risk tolerance
• You will monitor your trading activity regularly
• You will not use the Bot for market manipulation or illegal activities

7. API Usage

7.1 Rate Limits

API access is subject to the following rate limits:

• Free/Starter: 60 requests per minute
• Pro: 300 requests per minute
• Enterprise: Custom limits available

7.2 API Responsibilities

When using our API, you agree to:

• Secure your API keys and never share them publicly
• Implement proper error handling
• Not attempt to circumvent rate limits
• Report any security vulnerabilities responsibly

8. Data Processing

8.1 Data Collection

We collect and process the following data:

• Account registration information
• Trading history and performance metrics
• Bot configuration settings
• Technical logs and analytics
• Wallet addresses (public keys only)

8.2 Data Security

We implement industry-standard security measures including:

• End-to-end encryption for data transmission
• AES-256 encryption for stored data
• Regular security audits
• Access controls and monitoring

8.3 Data Retention

Trading data is retained for 2 years after account closure. You may request deletion of your personal data at any time, subject to legal retention requirements.

You are responsible for:

• Enabling two-factor authentication
• Keeping your devices secure
• Reporting unauthorized access immediately

10. Technical Support

10.1 Support Channels

Technical support is available through:

• Help Center documentation
• Email support (response within 24-48 hours)
• Live chat (Pro and Enterprise plans)
• Telegram community

10.2 Support Scope

Our support covers:

• Platform functionality and configuration
• Technical issues and bug reports
• Account and billing inquiries

Support does NOT include trading advice, investment recommendations, or wallet recovery.

11. Software Updates

We may periodically release updates to improve functionality, security, and performance. Updates may:

• Be applied automatically without prior notice
• Temporarily interrupt services during maintenance windows
• Modify, add, or remove features
• Change system requirements

Major updates affecting functionality will be announced at least 7 days in advance when possible.

12. Third-Party Services

Our Platform integrates with third-party services including:

• pump.fun - Token launch platform
• Solana Blockchain - Transaction processing
• Phantom/Solflare Wallets - Wallet connections
• Payment Processors - Subscription payments

We are not responsible for the availability, accuracy, or reliability of third-party services. Your use of third-party services is subject to their respective terms and conditions.

13. Dispute Resolution

13.1 Informal Resolution

Before initiating formal proceedings, both parties agree to attempt informal resolution by contacting our support team.

13.2 Arbitration

Any disputes not resolved informally shall be settled by binding arbitration. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

13.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.

14. Force Majeure

Neither party shall be liable for any failure or delay in performing obligations due to circumstances beyond reasonable control, including but not limited to:

• Natural disasters or acts of God
• War, terrorism, or civil unrest
• Government actions or regulatory changes
• Internet or telecommunications failures
• Blockchain network congestion or failures
• Cyber attacks or security breaches affecting third-party services

15. Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

This Agreement, together with our Terms of Use, Privacy Policy, and any applicable plan-specific terms, constitutes the entire agreement between you and PumpFun Sniper Bot regarding your use of our Services.

This Agreement supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written.

No waiver of any provision of this Agreement shall be deemed a further or continuing waiver of such provision or any other provision.
